Terms of Service

Effective Date: December 31, 2024  ·  Last Updated: December 31, 2024

These Terms of Service ("Terms") govern your access to and use of trueform-concrete.com (the "Site"), as well as any communications, estimates, scheduling, or services provided by True Form Concrete LLC ("True Form Concrete," "we," "us," or "our"). By using the Site or engaging us for services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. Services

True Form Concrete provides residential and light commercial concrete services in St. Charles County, Missouri and surrounding St. Louis area suburbs, including but not limited to concrete patios, driveways, walkways, stamped concrete, decorative finishes, grading, site preparation, and concrete repair. The full scope of any project will be defined in a separate written estimate or contract provided to you before work begins.

2. Estimates and Quotes

Information you submit through the Site contact form, or by phone, email, or text, is treated as a request for an estimate. Estimates we provide are non-binding until both parties sign a written agreement or contract. Estimates are typically valid for thirty (30) days from the date issued. Actual project pricing may vary based on site conditions discovered during excavation, material price changes, or scope changes requested by you.

3. Communications — Email, Phone, and SMS

3.1 General Communications

By submitting a form on the Site or otherwise providing your contact information, you consent to be contacted by True Form Concrete by phone, email, and (if you have opted in) text message regarding your inquiry, estimate, scheduled work, or follow-up.

3.2 SMS / Text Message Program

If you opt in to receive text messages from True Form Concrete — by checking a consent box, replying YES to a confirmation message, or otherwise providing affirmative consent — you agree to receive recurring transactional and informational text messages relating to your project, estimate, scheduling, appointment reminders, and follow-up.

Your mobile information and opt-in data will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details on how we handle your information.

4. User Conduct

When using the Site or our services, you agree:

5. Intellectual Property

All content on the Site — including text, photographs of completed projects, logos, graphics, and design elements — is the property of True Form Concrete or its licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, modify, or use any Site content without our prior written consent, except for personal, non-commercial reference.

6. Third-Party Links

The Site may link to third-party websites or services that we do not own or control. We are not responsible for the content, privacy practices, or policies of any third-party site, and access to them is at your own risk.

7. Disclaimers

The Site is provided "as is" and "as available." To the maximum extent allowed by law, True Form Concrete disclaims all warranties — express, implied, or statutory — relating to the Site, including any warranties of merchantability, fitness for a particular purpose, accuracy of content, or non-infringement.

Estimates, project timelines, and information on the Site are for general reference. Actual project terms are governed by the written contract executed between True Form Concrete and the customer for that specific project.

8. Limitation of Liability

To the maximum extent permitted by applicable law, True Form Concrete, its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site, even if advised of the possibility of such damages. Our total cumulative liability arising from or related to the Site shall not exceed one hundred U.S. dollars ($100). Project-related liability is governed by the written contract for that project.

9. Indemnification

You agree to indemnify and hold True Form Concrete harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your misuse of the Site, violation of these Terms, or violation of any law or third-party right.

10. Governing Law & Venue

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in St. Charles County, Missouri, and you consent to the jurisdiction of those courts.

11. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page indicates when the Terms were most recently revised. Material changes will be reflected on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
